Section D: Terms & Condintions.

Next of Kin Eighth Edition

Terms and Conditions

Agreement to Participate

Agreement is confirmed upon payment of the application fee, submission of required applicant information, and all relevant documents, including artwork details. By submitting the entry form, you agree to the conditions outlined in this document, and your signature or acceptance of the terms signifies your commitment to comply with the specified requirements.

Please note that the application form, along with these terms and conditions, constitutes the artist-gallery contract.

Upon selection as a participating artist, you commit to submitting artworks within the specified art specializations. If registration requirements change after your entry submission, you agree to comply.

Additionally, as an applicant or if selected as one of the participating artists, you will be required to attend the Press Conference and other media-related events organized for the Next of Kin Eighth Edition, provided you are in Nigeria at the time.

Applicants from outside Nigeria who are selected for the exhibition will be responsible for covering all expenses related to their travel and accommodation in Nigeria if they choose to attend the grand opening.

⚠️ Important: Agreeing to immediate disqualification will result from the identification of artworks belonging to another artist, along with the use of unlawful, counterfeit, or deceptive information and documents.

Delivery and Return

If selected as one of the exhibiting finalists, the artworks you deliver for exhibition at the grand finale must match those submitted for entry and be ready for gallery display. Any artwork deemed unsuitable for exhibition before the grand opening/finale will result in disqualification unless a suitable replacement is promptly provided upon the request of the Jury and Gallery Management.

If your entry is selected by the Jury for the grand finale and you are in Nigeria, you commit to ensuring your presence and the timely delivery of your artworks throughout the scheduled grand opening/finale. Artworks must be delivered in appropriate, reusable containers or packaging, meeting the professional standards expected for such pieces. You will also be responsible for the costs associated with (un)stretching, shipping, and framing.

When applying, refrain from submitting artworks that you cannot ensure will be available for display in the event of selection for the (grand opening/finale) exhibition.

Video and Photograph

By agreeing, you consent to being filmed alongside your entry(ies) for the purpose of website content, social media posts, sales advertisements, event promotions, cataloging, and unrestricted inclusion in marketing and other activities associated with Next of Kin before, during, and after the event. In the event of selection and attendance (or non-selection), you also permit the capturing of your images, voice, and video as part of the media promotions content for the grand opening/finale.

Insurance

While our staff will guarantee the meticulous handling, presentation, and security of artworks provided for the grand opening/finale, the gallery cannot assume responsibility for any inadvertent or accidental damage sustained by the artwork(s) prior to, during, and following the exhibition. Furthermore, the gallery will not be accountable for securing insurance for the artwork(s).

Artworks Sale

💰 Price Limitation: The prices of artworks will not exceed 800,000 naira. You also agree to allow the gallery to review your pricing, and the gallery will provide guidance if your works are considered overpriced. Once this form is submitted, the price information cannot be altered.

Upon being selected for the grand opening/finale exhibition, Thought Pyramid Art Centre will receive a non-negotiable 40% commission on the sale of each exhibited artwork. If the gallery expresses interest, unsold artworks may be eligible for purchase at prices to be mutually negotiated and agreed upon by the artist and the gallery. If an agreement cannot be reached regarding the purchase of the artwork(s), it is the artist's responsibility to arrange for the pickup and cover the return shipping costs within the gallery's specified deadline. Failure to comply will result in the artist accepting the gallery's decision regarding the handling of such artworks.

Jury Decision

By accepting, you commit to respecting the judgment of the jury and strictly abiding by the rules and regulations of Next of Kin, including any new or unforeseen directives issued by the Jury and Gallery management.

Final Agreement

By accepting, you affirm your commitment to uphold these terms and conditions. Additionally, you acknowledge that violating this agreement may result in the cancellation/disqualification of your entry and potential fines, as determined by the Jury.
